These Terms & Conditions govern the use of this website and products operated by Baronelwood Horsemanship LLC, doing business as Equine Pro Balancer. 

Welcome to the Equine Pro Balancer website. By accessing this website, purchasing our products, or using the Equine Pro Balancer, you agree to be bound by the following Terms & Conditions. Please read them carefully.

If you do not agree with these terms, please do not use this website or purchase our products.

General Use Disclaimer

The Equine Pro Balancer is a training aid intended to support clearer communication between horse and rider. It is not a substitute for proper training, professional instruction, veterinary care, or appropriate horsemanship.

Use of the Equine Pro Balancer is entirely at the user’s own risk. Horses are large, powerful animals, and equestrian activities involve inherent risks that cannot be eliminated by any product or equipment.

Assumption of Risk

By purchasing and/or using the Equine Pro Balancer, you acknowledge and voluntarily assume all risks associated with horseback riding, training, handling, and working with horses. These risks include, but are not limited to, personal injury, death, or damage to horse, rider, handler, or bystanders. 

Florida Equine Activity Liability Notice

Under Florida law, an equine activity sponsor or equine professional is not liable for an injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities, pursuant to Florida Statutes §773.01–§773.06.

Inherent risks include, but are not limited to:

  • the behavior of horses
  • surface and environmental conditions
  • the unpredictable reactions of horses to sounds, movements, objects, or other animals

No Guarantee of Results

Because horses vary in temperament, genetics, training history, physical condition, and environment, individual results may vary. No specific training outcome, behavioral improvement, or performance result is guaranteed. 

Proper Use Requirement

The Equine Pro Balancer must be used only as intended and introduced appropriately. Improper fitting, misuse, or use outside of its intended purpose may increase the risk of injury or ineffective results.

The user is solely responsible for:

  • ensuring proper fit
  • introducing the product safely
  • supervising its use
  • following sound training practices

Health & Welfare Notice

 If a horse’s behavior is new, escalating, or severe, users are strongly encouraged to consult a licensed veterinarian, qualified trainer, or equine professional to rule out pain, injury, dental issues, ulcers, saddle fit problems, or other health-related causes.

The Equine Pro Balancer does not diagnose, treat, cure, or prevent any disease or medical condition. 

Limitation of Liability

 To the fullest extent permitted by Florida law, the Equine Pro Balancer, its owners, representatives, affiliates, agents, and assigns shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or misuse of the product or website. 

Indemnification

By purchasing or using the Equine Pro Balancer, you agree to indemnify, defend, and hold harmless the Equine Pro Balancer, its owners, representatives, affiliates, and agents from any claims, losses, damages, liabilities, or expenses arising from your use or misuse of the product. 

Intellectual Property

All content, product designs, images, logos, text, graphics, and materials associated with the Equine Pro Balancer are protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, modified, or used without prior written permission.

Policy Changes

We reserve the right to update or modify these Terms & Conditions at any time without prior notice. Continued use of the website or product constitutes acceptance of any updated terms. 

Governing Law & Venue

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.

Any legal action or proceeding arising out of or related to these terms shall be brought exclusively in the state or federal courts located within the State of Florida.
